RELEASE AND WAIVER OF LIABILITY 

I acknowledge that my participation in the Activities in connection with Netflix Squid Games Season 3: The Final Game Activation (“Event”) may involve inherent risks and that I am voluntarily participating in the Activities with the full knowledge of risks and knowingly and freely accept any and all risks, both known and unknown, of injury (including, but not limited to allergic reactions).

I hereby release the Netflix Media LLC, MATTE LLC and their respective parents, affiliates, and subsidiaries, and each of their respective officers, employees, directors, legal representatives, agents, successors, and assigns (collectively, the “Releasees”) from and against any and all existing claims or any claims that may subsequently arise, based upon my participation in the Event. I agree that I shall not commence or maintain any suit, proceeding, claim or action whatsoever against Releasees whether at law or equity. This release and all terms thereof shall be binding upon, and insure to, the benefit of the parties, their successors, assigns and executors, administrators, personal representatives, and heirs. I waive the benefits of any statute or law that purports to limit the effect of this release and waive the benefit of any provision of law known as “moral rights” or similar laws.

I agree not to sue Netflix Media LLC, MATTE LLC, or any of its agents, employees, officers, directors, affiliates, successors or assigns, or initiate or assist in the prosecution of any claim for damages or cause of action against any of them, which I, on behalf of myself may have as a result of any personal injury, death, or property damage that I may sustain by participating in any activities provided by Netflix Media LLC or MATTE LLC.

I agree to indemnify and hold harmless Netflix Media LLC, MATTE LLC and its agents, employees, officers, directors, affiliates, successors and assigns from any and all liabilities, claims, costs, and expenses (including reasonable attorneys’ fees) made by other individuals or entities as a result of my participating minor child’s/children’s in connection with any activities provided by Netflix Media LLC or MATTE LLC.

Netflix Media LLC or MATTE LLC has no responsibility for lost, damaged, or stolen items.

I grant Netflix Media LLC and MATTE LLC the right to photograph, videotape, and/or record me and to use my name, face, likeness, voice, and appearance in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation, and I waive any right to royalties or other compensation arising from any such use.

This agreement shall be governed and construed and enforced in accordance with the substantive laws of the State of New York without regard to its conflict of laws provisions.  Participant hereby consents to jurisdiction and venue in the state and federal courts of the State of New York.  Participant hereby waives, to the fullest extent permitted by law, any right to trial by jury in any action, suit, claim or proceeding brought to enforce, defend, or interpret any rights or remedies arising hereunder, relating to, or in connection with this agreement. If any term or provision of this agreement should be declared invalid by a court of competent jurisdiction, the remaining terms and provisions of this agreement shall remain unimpaired and in full force and effect. 

I represent and warrant that I am over the age of 18 or majority, whichever is older, in my state of residence, or that my parent or legal guardian will sign on my behalf.  I acknowledge that I have carefully read this document in its entirety and understand that it is a release of claims and a waiver of liability regarding my participation in Activities. I represent and warrant that I have the full power and authority to enter into this agreement and that I accept it of my own free will.
