  15. When can I expect to receive my benefits?
  16. The settlement was approved by the San Francisco Superior Court on July 28, 2006, but certain objectors appealed the judgment approving the settlement. The appellants filed their opening briefs in August 2007. The settlement benefit will not be distributed until the appeals process is completed, which could take until mid-2008 or later. Class members who timely and accurately completed the Claim Form Process will be contacted by email when the settlement benefit is available to them.

  17. How long do I have to file a Claim?
  18. The deadline was June 26, 2006. You may no longer register for the settlement.

  19. I already received notice about this settlement; why did I get another notice?
  20. The terms of the settlement were revised and require that you receive a supplemental notice. See Section I of the Amended Long Form Notice.

  21. Why is the emailed notice that I received different from the one my friend received?
  22. Under the Amended Settlement Agreement, Class Members who had not responded to the original notice received this notice, Class Members who had already registered for the benefit received this notice, and Class Members who had elected to opt-out of the original agreement received this notice.

  23. I understand that the settlement has been amended. Do I have to register again if I previously registered?
  24. No. Please refer to Section IV.B of the Amended Long Form Notice.Registration closed on June 26, 2006.

  25. How did the settlement change? Will I be charged for the settlement benefit under the revised settlement?
  26. You will need to review the comparison of the original Settlement Agreement to the Amended Settlement Agreement to see all the changes made to the settlement. However, an important change is that the benefit will not automatically renew.

    The Class Members that simply do nothing, and that do not expressly elect to continue the benefit level of service, will not be charged membership fees for the benefit level of service because the benefit will simply terminate at the end of the benefit month.

    If you are an eligible former Netflix member and sign up for the free one-month membership, your membership will end automatically unless you unless you choose to continue your service and pay the regular subscription rate after the free month. If you do not choose to continue the service, you must return all rented DVDs within 7 days following the expiration of the free month or be subject to charge for the outstanding DVDs under Netflix's standard policy (currently, $20 per DVD).

    If you are an eligible current Netflix member and sign up for the free one-month upgrade, your upgraded membership will return to your previous service level unless you choose to continue the upgraded service and pay the regular subscription rate for that level after the upgraded month.

  27. I previously opt-ed out of the settlement. Is it too late for me to claim the benefit?
  28. Registration closed on June 26, 2006. Please refer to Section VII.A.2 of the Amended Long Form Notice.

  29. Where can I go for additional information?
  30. Any questions you may have about the settlement should be directed in writing to either of Plaintiffs' Co-Lead Counsel whose addresses are provided in the Long Form Notice. Please do not direct any questions to the Court.

  31. What happens if I change my address after I register through the Claim Form Process?
  32. If your address or email address changes after you have completed the Claim Form Process you must notify Netflix of your new address by clicking on "Member Sign In" and then selecting "Your Account". Simply follow the instructions to update your information.
